DIWALI SPECIAL FLIGHT PACKAGE - MAJESTIC KERALA – 11 Days - 10 Nights

1. YOUR CONTRACT: All tours in this brochure are operated by  Shree Rajyash Holidays when a booking is made, which is accepted. by us, it constitutes a contract between you & Rajyash Holidays . All bookings are taken on the basis that you accept these terms and conditions. We are travel organizers only. We do not control or operate any Airline, neither do we own or control and shipping company, coach or Coach Company, hotel, transport or any other facility or service mentioned in this brochure.  We take care in selecting all the ingredients in your holiday, but because we only select and inspect them and have no other control in the running of them, we cannot be held responsible for any injury, death, loss or damage. Or deficiency in services which is caused by the act or default of management or employees of an independent contractor arising outside our normal selection and inspection process. (The Contract and the Disputes, if any will be subject to the jurisdiction of Mumbai courts only.)  
2. VALIDITY: Itineraries, resorts, hotels, airlines, cruise, rail, and prices published in this brochure are subject to change any time without prior notice.
3. PRICES: Any increase in air/rail/hotel/transportation fare prior to the date of departure will have to be borne by the passenger.
4. HOTELS: Though we have published the names to the hotels for each tour, we reserve the right to change the same due to unavoidable circumstances, when we may have to provide alternative, similar accommodation, for which no refund shall be allowed. The rooms shall be allotted as per the check –in time of the hotels, any they shall have to be vacted as per the hotels check –out time. The difference between Standard, Deluxe and V.I.P. tours is only in the hotels, remaining all our services are same. In some hotels the rooms may be twin bedded.
5. OUR BUS: Seat numbers in the bus are provided on first come first serve basis, as per the booking date, and the seat numbers remain fixed throughout the tour. Still the passengers may interchange their seats with their seats with their co-passengers, on mutual consent. After getting down from the train /Air /Ship /Cruise , all onward journey will be by 2 x 2 Luxury A.C. OR Non A/C bus only. But if in a tour there are less number of passengers, then we may provide a car or matador or mini bus. We will provide Indica, Sumo, Qualies, Jeep (Darjeeling & Gangtok) Due to unavoidable circumstances, if there is any road block. Or traffic jam, you will have to co-operate with the tour manager. In case of a accident, please follow the instructions of the tour manager to reach the next destination, in such cases we are not responsible for the damage to your luggage or any injury to the passenger.
6.  LUGGAGE: During the entire tour (Except for the train journey) our staff will be at your service to carry your luggage Except international Route  but at the same time we are not responsible for the theft or damage to your luggage. In any condition any type of refund will not be given.
7. OUR TOUR MANAGER: As soon as you get down from the train / air, our tour manager will be with you throughout the tour, and we advise you to co-operate with our manager in all respect to make your tour really enjoyable. All outment of rooms, selection the daily food menu, is the duty of the tour manager, and passengers should not interfere in these matters. Passengers  indulging in unwanted hindrance, in the smooth operation of the of the tour, or quarreling with the manager or other passengers, shall be asked to leave the tour at that spot, and shall not be given any refund for the same.  
8. OUR FOOD: During the tour we will provide delicious, pure vegetarian, food, specially prepared for you, by our own expert chef. Which includes morning breakfast, lunch, evening tea/coffee, & dinner. Also note that during the to & fro train /Flight journey we do not provide any food service.
9. UNAVOIDABLE CIRCUMSTANCES: If due to reasons  beyond our control like riots, flood, political unrest, bandhs, accidents, or any other natural, or manmade calamities, Pandamic  the programme of the tour has to be changed, or extended, the additional expenditure for the same will have to be borne by the passengers. If any passengers, has to leave the tour mid –way, due to any reasons like death of relative, or illness, or any other reasons, there shall be no refund for the remaining .,Portion of the tour. And the expenses for returning back to Mumbai also shall be borne by the passengers. Passengers are advised against carrying expensive jewelry, cameras, etc. in the tour, and if they bring them in the tour, it shall be at their own risk, we shall in no way be responsible for the theft or damage if due to reasons beyond our control, we have to cancel some sightseeing places, there shall be no refund for the same. If a tour is cancelled from our part then cost and responsibility of organising the new tour will be of passengers only. Any dispute will be subject to Mumbai Jurisdiction. Note:  The Company shall not accept any liability or responsibility for any damages, loss, injury accident, death, delay, breakdown or irregularity which may occur in carrying out the tour arrangement. (In the event of a passenger falling ill or suffering any accident during the journey, all hospital expenses, doctor fees, repatriation expenses any other charges incurred as a director in direct result of his/her illness/ accident are the responsibility of the passenger, (Management reserves the right to claim any additional expenses due to delay or changes in train, airplane, bus ship or other service weather conditions, strikes, war quarantine any other cause whatsoever and such loss or expenses must be borne by the passenger.
10. BOOKING & CANCELLATIONS: You can confirm your booking in our tour by paying deposit of Rs. __25000/- /- (If any higher class in train or air is required the difference should also be paid in advance) out of this Rs.15000/- + Railways /Air cancellation charge is non refundable and non transferable. The balance payment shall be paid 30 days prior to the departure of the tour. If anybody fails to pay the balance amount before 15 days, he shall be deemed as canceled, and the deposit shall not be refunded. If we cancel the tour, then we shall refund the amount. But if we are forced to cancel the tour due to the natural calamities. Like flood, riots, bandhs, strikes ,Pandemic , manmade calamities etc; then we shall refund the tour cost after deducting 10% as our service charge, for making the necessary arrangements for your tour. If the passenger wants to cancel the tour he shall have to make a written application to our office, and we shall refund the tour cost after deducting Cancelation charges 30 Days after finishing of Tours 
11. THINGS NOT INCLUDED IN THE TOUR COST: Any increases in Air or Rail fares after 1^st February 2005 personal expenses like tips, Cold drinks, Horse riding, Boating, Laundry, Cable car rides, room heater, taxi fare, mineral water, personal things, insurance, additional expenses after accidents. We take it for granted that all passengers who join the tour have read this terms and conditions, and agree to the same.
12. COMPLAINTS DURING THE TOUR: If the passengers have any complaints regarding our services, like hotel, bus, etc.are advised to inform our office. Immediately, by phone/fax so that the same can be readdressed on the spot, no complaints or refund for the same be entertained after reaching Mumbai.
13.  FLIGHT JOURNEY: Please be noted tour book with the flight journey, in any case flight will delay or cancel shree rajyash Holidays  will not be responsible to arrange any other mode of transport to reach destination. Customers have to born all expenses at there own cost.
14. AMENDMENTS: In case of amendments like change the travel date or change of hotel or the dates of stay at a particular destination, the cancellation charges would apply. If any of the above is made less than 48 working hrs, the cancellation charges would apply as per the hotel rules & regulations.
15. REFUND AND CANCELLATIONS: All the cancellations and amendments are to be intimated to our offices in writing or else they would not be entertained.

    When a cancellation is made	Cancellation Charges
    120 to 45 days or prior to the date of departure.	10% of Total tour cost.
    30 to 44 days or prior to the date of departure.	20% of Total tour cost.
    15 to 29 days or prior to the date of departure.	50% of Total tour cost.
    5 to 14 days or prior to the date of departure.	90% of Total tour cost.
    Within 4 days to the date of departure.	100% of Cancellation or no refund

16. No refund will be provided for unutilized sectors/services. It is imperative on all the tourists who are joining our tour and those who are FIT (Free Individual Travel) to be abide by and strictly comply and observe all the terms and conditions laid down herein.
17. All Terms & Conditions as per Rajyash Tour & Travel Consumer Disclosure Notice will apply subject to jurisdiction of Mumbai Courts only.
